Article 189-1 of the Criminal Code of the Republic of Azerbaijan


Article 189-1 of the

Criminal Code of the Republic of Azerbaijan 

 

Article 189-1. Plundering of natural gas, water, electricity or heating energy [453]

 

189-1.1. Plundering of resources through illegal connection to natural gas, water supply, electricity or heating networks, resulting in infliction of a significant damage, - [454]

shall be punished by a fine of two thousand to four thousand manats, or correctional labour for a period of up to two years, or restriction of liberty for a period of up to two years, or restriction of liberty for a period of up to two years. [455]

189-1.2. The same acts resulting in infliction of a large damage -

shall be punished by a fine of four thousand to six thousand manats, or restriction of liberty for a period of one to three years, or restriction of liberty for a period of up to three years or deprivation of liberty for a period of up to three years. [456]

189-1.2-1. The acts provided for in Article 189-1.1 of this Code resulting in infliction of a particularly large damage — [457]

shall be punished by deprivation of liberty for a period of three to seven years.

189-1.3. Failure to prevent the acts provided for in Articles 189-1.1, 189-1.2 or 189-1.2.1 of this Code as a result of non-fulfilment or improper fulfilment of their service duties by an authorised representative, who is not an official, of natural gas, water, electricity or heating energy supply enterprises, due to dishonest or negligent attitude towards the job -   [458]

shall be punished by a fine of three thousand to four thousand manats, or restriction of liberty for a period of one to three years, or restriction of liberty for a period of up to three years or deprivation of liberty for a period of two to four years.  [459]

189-1.4. Failure to prevent the acts provided for in Articles 189-1.1, 189-1.2 or 189-1.2-1 of this Code by an authorised representative, who is not an official, of natural gas, water, electricity or heating energy supply enterprises, to fulfil or properly fulfil their service duties as a result of greed involving abuse of official position or other personal interest - 

shall be punished by a fine of four thousand to six thousand manats, or restriction of freedom for a period of two to five years, or restriction of freedom for a period of up to three years, or deprivation of liberty for a period of four to six years. [460]

An individual who commits, for the first time, the offences referred to in Articles 189-1.1 or 189-1.2 of this Code and fully compensates for the damage caused by the crime, shall be exempt from criminal liability.
